G5 Employment Contract

This Addendum to the G5 Employment Contract of World Bank Group (the “Bank”) establishes increased minimum standards for Bank staff members employing G5 domestic employees to ensure their fair treatment, consistent with the applicable provisions of U.S. law and the Staff Rules. Compliance with the requirements of this Contract Addendum, which include certain increased terms of employment from the Department of State issued minimum terms, is mandatory and subject to audit. Staff members must certify acceptance of their obligations hereunder upon requesting Bank sponsorship for a G5 visa applications, the renewal of a G5 visa, or the extension of a Form I-94. Violations of the staff member’s obligations hereunder may result in appropriate disciplinary action against the staff member, up to and including dismissal.

I.         Medical Insurance.  The Employer is required to provide at no cost to the Employee medical insurance meeting the minimum essential coverage required to meet the individual responsibility requirement under the Affordable Care Act.  The Employer must pay all medical costs incurred by the G5 employee (insurance premiums, co-payments, deductibles, etc.) and the costs of medical expenses may not be deducted from the Employee’s wages.  The only permissible wage deductions are those required by law. The Employer is expected to pay any outstanding domestic worker medical bills before the Employee leaves the United States.

II.         Tax Payments.  The Employer shall ensure that the Employee obtains a U.S. Social Security Card and shall pay the Employer’s share of Social Security taxes and Medicare, as well as any other required taxes or contributions, including federal and state unemployment insurance and Workers Compensation insurance, on all wages actually paid.  The Employee must pay the Employee’s share of Social Security and any applicable federal and state income taxes on all wages.

III.         Complaint Procedure. The Employee has the right to make a complaint, or to have a complaint made on his or her behalf, with respect to the Employee’s fair treatment under the World Bank Group’s Code of Conduct Regarding Employment of G5 Domestic Employees.  Such a complaint may be filed with the World Bank’s Office of Business Ethics (202-473-0279).  The World Bank Group’s complaint procedures shall not prevent the Employee from notifying governmental authorities or taking legal action in connections with any matter affecting his or her employment.  The Employer may not interfere with such complaints or retaliate against the employee for any good faith statement or action by or on behalf of the Employee in connection with a complaint.

IV.         Freedom of Movement. The Employer is required to provide full freedom of movement for the Employee into and/or out of the residence of employment and communicate such understanding to the Employee.  The Employer may not interfere with the Employee’s movements as part of their duties as an employee or prevent the Employee from accessing/leaving the employment residence at any time

V.         In-Person Interviews with State Department. The employee is required to attend an in-person interview with, and scheduled by, the US State Department within 90 days of arrival to the US to certify compliance with signed employment contract.  The Employer shall make the Employee available to attend the in-person interview with as little delay as possible. The Employer is not permitted to accompany Employee or attempt to exert influence over Employee response to questions presented by State Department at the in-person interview.  The Employee will attend subsequent annual in-person interviews with the US Department of State for the duration of the employment contract period.

VI.         Audit of Staff Member’s Records.  The Employer’s records regarding the Employee are subject to audit periodically or in response to a complaint by or on behalf of the Employee.  The Employer shall cooperate fully and unconditionally with requests made in connection with such an audit by the Bank.  Employers are required to use professional service firms designated by the Bank for G5 payroll and/or tax reporting obligations.
